This Common Law Order Book 1 begins April term 1809 with the appointment of Jas D. Carrell as Clerk of Court Russell Co. (two pages at the end of the book are from 1808); excepting the 1808 entry, this book ends at court 1824 with the debt case of Alderson and Creigh, merchants against Gents and Hicks. This book is composed primarily of cases, some tried by juries (transcribed) for a plethora of reasons such as malicious prosecution, retailing ardent spirits without license, in trover, slaves suing for freedom, assault, assault and battery, obstructions, slander, dereliction of duty, appeals, in case, failure to attend jury (venire); barn burning, breach of peach, buggery ad inf. Not infrequently the plaintiff or defendant has died since implementation of suit (giving an estimated window of death); some indentures are listed as submitted to court and admitted to record as well as a rare last will and testament.
