In April 2022 the BSAct was enacted and the move towards implementation is now making more positive progress. RIBA representatives have been taking an active role on various government led committees to establish an equitable structure to the secondary legislation and industry guidance that is required for its implementation. The Act is very wide ranging introducing new “Duty-holders” and enhancing the competence requirements of other “Built Environment” personnel from clients to installers including Architects, for whom this course is directed. The whole process by which buildings are designed to meet Building Regulations requirements will need to be re-evaluated to include a clear demonstration of how the major fire and structural decisions have been made on “All Buildings” but with greater scrutiny on “Higher Risk Buildings”. The whole building regulatory process will be modified, and the new Building Safety Regulator (BSR) will be led by the Health & Safety Executive (HSE) with the support of local authority or independent Building Control Approvers and the Fire Brigade. The BSR will introduce a cost recovery invoicing procedure for consultation meetings, formal submission reviews and possible interventions for non-compliance all of which is likely to be introduced in April 2023. From this point there will a six-month transitional period for the new duty-holders to establish themselves and adjust to the new regime by October 2023. The new Principal Designer function and role at Organizational & Individual levels will need to be established and RIBA are preparing the way for their training, appointments and integration. This course will focus on the increased ‘Skills, knowledge, experience and behaviours’ required by Architects to prepare them for this process and provide certification to demonstrate the competence required. Architects are well placed as ‘the designers in control of the design phase’ on architectural projects and the regulators are looking to them to enhance and demonstrate their competence and absorb the new Principal Designer role into their professional lives.
