EQUIPMENT PURCHASE & WAIVERIn purchasing this Equipment, Buyer agrees to the following TERMS and CONDITIONS: 1. Buyer is purchasing the Equipment for his or her personal use and for use by any household member of his or her family. Buyer will not use or permit the use of the Equipment for any commercial or public purpose. For the purpose of this Agreement the term "Buyer" will include any household member using the Equipment. 2. All of Seller's intellectual property including product design, materials, engineering design, trademarks, labels, product identification, artwork, and marketing materials remain the property of Seller. Buyer will not reproduce, reverse engineer, copy, modify the Equipment for personal use, gift, or sale. 3. Buyer fully understands and acknowledges that fitness activities have: Inherent risks, dangers, hazards, and such exist in Buyer's use of the Equipment. Buyer's use of the Equipment may result in injury or illness including, but not limited to, bodily harm, disease, strains, fractures, partial and/or total paralysis, death or other ailments that could cause serious disability. By using the Equipment, Buyer hereby assumes all risks and dangers and all responsibility for any losses and/or damages. 4. Buyer, on behalf of him or herself, his or her personal representatives and heirs, hereby voluntarily releases, waives, discharges, holds harmless, defends, and agrees to indemnify Seller and its owners, officers, directors, representatives, and employees, from any and all claims, actions or losses for bodily injury, property damage, or wrongful death which may arise out of the use of the Equipment.
